Trial Case: Client was charged with indecent exposure for allegedly masturbating at a public park adjacent to a school. In 2006, client was convicted of Felony Sexual Assault of a Child by Exposure and served prison time. Client is a registered sex offender and also had a prior conviction for misdemeanor Indecent Exposure. In closing arguments, Billy Skinner asked the jury to focus on the jury charge from the Judge, ignore the “smoke” the government had presented of client’s past and focus on the testimony regarding this specific allegation. BS challenged the Jury to weigh the conflicting testimony of the complaining witness and the two police officers against the testimony of our client. During the jury deliberation, the Prosecutor again offered a plea bargain and we refused to accept it. After several hours of deliberation, the jury found client NOT GUILTY.
