What is indecency with a child?
According to the Texas Penal Code, Title 5, Chapter 21, § 21.11, a person commits indecency with a child when he / she engages in sexual contact with a child or causes a child to engage in sexual contact. The term “sexual contact” can refer to any of the following acts:
- Exposing a child to nudity (with full knowledge of the child’s presence)
- Causing a child to expose his / her genitals
In order to obtain a conviction, the prosecution must demonstrate that the defendant committed one of these acts for the purpose of sexual gratification.
Defense Under Texas Penal Code § 21.11
Texas law describes several defenses for this crime. For instance, an individual can only commit indecency with a child if he / she is of the opposite sex of the victim, did not force the victim to make sexual contact, and was less than three years older than the victim. This defense is irrelevant if the defendant was already convicted of a similar crime or is a life-time registered sex offender.
It is also a valid legal defense against this charge if the defendant and the victim were legally married at the time of the act.
Indecency with a Child is a Felony in Texas
Depending the circumstances surrounding the case, indecency with a child is a second or third degree felony. According to § 21.11, it is a second-degree felony if the defendant is convicted of “engaging in sexual contact with the child or causing the child to engage in sexual contact.” On the other hand, this crime is a third-degree felony if the defendant allegedly exposed him / herself to the child or caused the child to expose him / herself for the sexual gratification of any person.
